Sports Registrar declares Nick Mwendwa ineligible to contest for FKF Presidency

Football Kenya Federation (FKF) President Nick Mwendwa could be serving his last term at the helm of the country’s football governing body after Sports Registrar Rose Wasike declared that the 44-year-old is not eligible to run for office again in the elections slated for later this year.

Having been elected into office for the first time in 2016, Mwendwa is nearing the end of the allowed two four-year terms as he retained his seat in the 2020 polls.

According to the Nation, Wasike has already issued a notice to the federation, informing the current FKF President that he should be ready to vacate office having hit the term limits.

"... the Second Schedule to the Sports Act provides for the term of office for elected officials as four years and one further term of four years," read the statement from Wasike as quoted on the Nation.

"Hence it means that since FKF was first registered on July 29, 2016, (copy of interim certificate attached) the current officials of FKF will complete their two terms of office on July 29, 2024, and will therefore not be eligible to vie in the upcoming elections,” Wasike noted.

Wasike went on to direct that the current officials should ensure that elections are duly held and the handing over of power to be made as smooth as possible as she explained how the Sports Act barred any sports official from serving in the same office for more than eight years.

“Therefore, the role of the officials whose terms have expired will be to ensure FKF elections are held according to the Constitution of Kenya 2010, the Sports Act, Sports Registrar Regulations, and any other relevant law and thereafter hand over the office to the newly elected officials,” she stated.

“This was ascertained by the Sports Disputes Tribunal (SDT) in SDTSC NO.E034 where the Tribunal declined to allow the 2nd and 3rd Respondents from vying.

Therefore, the role of officials whose terms of office have expired will be to ensure the FKF elections are held as per the law and thereafter handover office to the newly elected officials,” she concluded.

Apart from Mwendwa, four other top officials have also been declared not eligible to vie in the upcoming polls.

They include Mwendwa's deputy president Doris Petra and National Executive Committee (NEC) members Muriithi Nabea (Eastern), Joseph Andere (Nyanza) and Emos Kweya (Western).
